If they were enforcing their terms of service, Cox would have probably shut
you down for running emule. I don't have a copy of the Cox residential TOS, so
 I can't say for sure.

If ISPs were to more aggressively enforce TOSs, the internet would be a better
place, IMO and we wouldn't have the droves of infected zombies sending out
spam all over the place. Getting your connection pulled is usually enough
incentive to get someone to think about cleaning up their act.
